  • Bigamy
  • Conviction of a felony
  • Infecting the other spouse with an STD
  • Physical abuse or mental cruelty

By contrast, a no-fault divorce does not place blame or fault for the end of the marriage on either spouse. Illinois recognizes the following as grounds for a no-fault divorce:

  • Spouses have lived separate and apart for at least 2 years
  • Irreconcilable differences have caused the breakdown of the marriage

To file for a divorce in Illinois, you must first establish that you or your spouse have been residents of the state for the past 90 consecutive days and that your kids have lived in Illinois for the past six months. This is called a residency requirement.

This includes division of marital property, determining spousal maintenance payments, and determining child custody and support.
